Podcast Guest Release Agreement
This Podcast Guest Release (“Release”) is for the purpose of recording an interview for the You’re Overqualified Podcast (“Program”). The recording date will be determined after this agreement is submitted. This Release grants Danielle Tan (“Host”) and her agents, affiliates, licensees, successors, parents, subsidiaries, and assigns the rights to the recording and distribution as outlined below.
Grant of Rights
Guest grants the Host an irrevocable, perpetual, worldwide, royalty-free right to use the Guest’s name, voice, appearance, likeness, image, words, biography, participation, and title in connection with the recordings, in whole or in part, and in any derivative works. This grant includes rights for advertising, promotion, distribution, and any lawful purpose, covering all media formats, including social media, websites, marketing materials, and promotional content. This is granted without any expectation of compensation.
Ownership and Use
Host holds all rights, title, and interest in the recordings, including copyrights. Host reserves the right to reproduce, distribute, edit, and publish the recordings in any media, as well as license or assign these rights. Host is not obligated to use the recordings and retains discretion over whether the content will be aired or published.
Non-Airing of Episode
Guest acknowledges that Host has the right to decide, at her sole discretion, whether to air or publish the recordings, in whole or in part, without providing a reason and without liability for any consequences from the non-airing of the episode.
Representations and Warranties
Guest represents and warrants that they have the full right, power, and authority to enter into this Release and grant the rights herein. Guest confirms this does not conflict with any other agreements and does not infringe on third-party rights. Guest agrees to indemnify and hold Host harmless from any claims arising from Guest’s participation or any breach of these warranties.
Release of Liability
Guest releases Host and affiliates from any claims, liabilities, or damages, foreseeable or unforeseeable, arising from the recording, editing, production, or distribution of the Program, including defamation, privacy, or publicity claims, to the extent permitted by law.
Use for Marketing and Promotion
Guest agrees that the audio and video content may be used by Host for marketing and promotional purposes, including on social media, websites, advertising, and other activities related to the Program.
No Obligation
This Release does not obligate Host to use any of the rights granted or to provide compensation or reimbursement.
Governing Law
This Release is governed by the laws of the State of Illinois. Disputes shall be brought exclusively in Illinois state or federal courts, and Guest waives any objections regarding venue.
Electronic Signature and Agreement
By electronically submitting this form and checking the agreement box, Guest consents that their electronic signature has the same force as a physical signature and fully accepts the terms herein.
